Pursuant to Immigration Law BE2522 (AD1979), Section 54: Deportation of Aliens

“Any foreigner who enters or comes to remain in the Kingdom without permission or when such permission expires or is revoked, the competent official shall deport such foreigners out of the kingdom;”

This visa regulation is for foreigners who exceed their visa or visa-exempt permits; You must leave Thailand before your permit or visa expires. If you are caught before reaching the airport or land border, there will be possible arrest and detention.

What is Overstay?

Staying in Thailand beyond the ‘admitted until’ date that is stamped on your passport when you go through Thai Immigration on your return trip to Thailand means you are overstaying. Overstay means that you stay in Thailand beyond the date your visa gives you permission to stay. This is an offense under Thai law that is subject to arrest and detention.

Staying longer in Thailand could be intentional or unintentional. Either the person forgets the date they are supposed to leave, misinterprets the visa stamp, or something could have happened and the person cannot leave the country.

Exemption

The only exception to this regulation would be foreign children under 7 years of age. All foreigners are subject to fines for staying in Thailand beyond the age of seven.

What to do when you stay longer?

You cannot leave Thailand without paying the visa overstay penalty. You can come forward and report it, and clear up your overstay. Fines for overstaying a visa are THB500 per day, and increased by a maximum of 40 days, the maximum fine can be imposed to THB20,000. The fine is paid to the Immigration Bureau, Suvarnabhumi Airport, Immigration Bureau, other departure or border point.

If he cannot meet those requirements, he will be detained in the Immigration Bureau jail until he can acquire a confirmed ticket and enough cash for the trip to the airport. In extreme cases, especially for long stays, his name is registered on a secret ‘Confidential List’, popularly known as a ‘black list’; and you will be banned from Thailand forever. It is extremely difficult to remove your name from the ‘blacklist’.

Staying longer in Thailand can be difficult and complicated. It is advisable to avoid staying longer. If you do, stay away from activities that may attract the attention of the police, try to avoid any kind of trouble, pay the fine as soon as possible and leave Thailand.
